What does instructing you cost me?
After a no-fault traffic accident, the other party's liability insurer regularly covers the necessary legal fees. Legal expenses insurance is not required for this.
Do I need legal expenses insurance?
No. After a no-fault accident, the other party's insurer usually covers the costs. If you were at fault yourself, legal expenses insurance helps – we clarify this with you in advance.
May I choose an appraiser I trust?
Yes. After a no-fault accident you have the right to your own independent expert – not the one appointed by the other party's insurer.
How quickly will I get a response?
As a rule within 24 hours. The fastest way to reach us is via WhatsApp.
Do you also represent clients nationwide?
Yes. The matter is handled digitally, so we can represent you throughout Germany.
Do I have to accept the insurer's appraiser?
No. After a no-fault accident you may instruct your own independent expert – and the other party's insurer usually bears those costs. Experience shows that the insurer's appraisal report often turns out lower.
May I take a rental car after the accident?
After a no-fault accident, generally yes, for the duration of the repair or replacement purchase. Important: the rental car should be of the same class or smaller. Alternatively, you can claim loss of use – we advise you on which is more favourable.
What happens in the event of a total loss?
In the event of a total loss you usually receive the replacement value less the residual value of your vehicle. In addition, registration and deregistration costs, loss of use and further items may be added. Important: do not sell the vehicle hastily to residual value buyers sent by the insurer.
What is loss of use and how high is it?
If you cannot use your vehicle because of the accident and forgo a rental car, you are entitled to daily compensation – depending on the vehicle class usually between 23 and 175 euros per day, for the duration of the repair or replacement.
What is diminished value?
Even after a professional repair, an accident vehicle is worth less when sold. After a no-fault accident, the other party's insurer must compensate this loss in market value – it is often “forgotten” when no lawyer is involved.
How long does the settlement take?
Simple bodywork damage is often settled within 4–6 weeks. Where there are personal injuries or liability is disputed, it can take longer. We set deadlines and follow up consistently.
How high is my compensation for pain and suffering?
That depends on the type and severity of the injury, the duration of treatment and the consequences. Compensation tables and comparable court decisions provide guidance. Experience shows that an insurer's first offer is considerably below what is enforceable.
What should I do if the other driver flees the scene?
Call the police immediately and secure evidence (photos, witnesses). If the person responsible cannot be identified, the German traffic victims' fund (Verkehrsopferhilfe) may step in under certain conditions. We examine every avenue for you.
What applies to an accident abroad or involving a foreign vehicle?
Claims exist in these cases too – the matter is handled via the Green Card system or the claims representative of the foreign insurer in Germany. The process is more complex; legal assistance is particularly worthwhile here.
What applies to a leased vehicle?
With leasing, the lessor is the owner – claims for repair and diminished value partly belong to the lessor, whereas loss of use and compensation for pain and suffering belong to you. We coordinate the claims with the leasing company.
What applies to a company car?
The holder of the claim is usually the employer or the vehicle keeper. For you personally, compensation for pain and suffering and loss of earnings may come into consideration. We clarify the claim situation for everyone involved.
May I choose the repair shop freely or settle on a notional basis?
Yes, you are free to choose the repair shop. Alternatively, you can settle “notionally” on the basis of the appraisal report – in that case the net repair costs are usually paid out without you having to have the vehicle repaired. Which option makes more sense depends on the individual case.
The insurer is offering a quick, uncomplicated settlement – should I accept?
Be careful: quick offers and the “claims management” of the other party's insurer serve above all to keep costs down. Do not sign a settlement release before all claims have been examined.
What deadline applies to a fine notice?
You can only lodge an appeal against a fine notice within two weeks of service. So send us the notice as quickly as possible – we check for measurement errors and formal errors.
Will the insurer pay my loss of earnings?
Yes, where the accident has caused an incapacity for work, the loss of earnings has to be compensated – as does the loss of household management capacity if you cannot run your household. Self-employed people can claim lost profit.
