Answers after a traffic accident

What does instructing you cost me?

In a no-fault traffic accident, the other party's liability insurer regularly covers the necessary legal fees. No legal expenses insurance is required for this.

Do I need legal expenses insurance?

No. In a no-fault accident the other party's insurer usually covers the costs. If you are at fault, legal expenses insurance helps – we clarify this with you in advance.

May I choose my own expert?

Yes. In a no-fault accident you have the right to your own independent expert – not the one from the other party's insurer.

How quickly will I get a response?

Usually within 24 hours. The fastest way to reach us is via WhatsApp.

Do you also represent nationwide?

Yes. The process is digital, so we can represent you throughout Germany.

Do I have to accept the insurer's assessor?

No. After a non-fault accident you may instruct your own independent assessor – the costs are usually borne by the opposing insurer. Insurer-commissioned reports often come out lower.

Can I rent a car after the accident?

After a non-fault accident, generally yes – for the duration of the repair or replacement. Important: the rental should be the same class or smaller. Alternatively you can claim loss-of-use compensation – we advise you which is better.

What happens in case of a total loss?

In a total loss you receive the replacement value minus your vehicle's salvage value. Registration costs, loss of use and other items may be added. Important: don't rush to sell the vehicle to the insurer's salvage buyers.

What is loss-of-use compensation and how much is it?

If you cannot use your vehicle due to the accident and forgo a rental car, you are entitled to daily compensation – usually between €23 and €175 per day depending on vehicle class, for the repair or replacement period.

What is diminished value?

Even after proper repair, an accident vehicle is worth less on resale. The opposing insurer must compensate this loss after a non-fault accident – an item often "forgotten" when no lawyer is involved.

How long does the settlement take?

Simple vehicle damage is often settled within 4–6 weeks. Personal injury or disputed liability can take longer. We set deadlines so the insurer cannot play for time.

How much pain compensation will I receive?

It depends on the type and severity of the injury, treatment duration and consequences. Compensation tables and comparable judgments provide guidance. Insurers' first offers are typically well below what can be enforced.

What if the other driver flees the scene?

Call the police immediately and secure evidence (photos, witnesses). If the driver cannot be identified, the German traffic victims' fund (Verkehrsopferhilfe) may step in under certain conditions. We examine every avenue for you.

What about accidents abroad or with a foreign vehicle?

You still have claims – handled via the Green Card system or the foreign insurer's claims representative in Germany. The process is more complex; legal help is particularly worthwhile.

What applies to leased vehicles?

With leasing, the lessor owns the vehicle – repair and diminished-value claims partly belong to them, while loss of use and pain compensation are yours. We coordinate the claims with the leasing company.

What about company cars?

The claim holder is usually the employer or vehicle owner. For you personally, pain compensation and loss of earnings may apply. We clarify the claims for everyone involved.

Can I choose the repair shop freely or settle on a report basis?

Yes, you choose the repair shop. Alternatively you can settle "fictitiously" based on the assessor's report – you receive the net repair costs without having the car repaired. Which is better depends on the case.

The insurer offers a quick, simple settlement – should I accept?

Caution: quick offers and "claims management" by the opposing insurer mainly serve to cut costs. Do not sign a settlement release before all claims have been reviewed.

What is the deadline for objecting to a fine notice?

You can only object to a fine notice within two weeks of service. Send us the notice as soon as possible – we check for measurement and formal errors.

Does the insurer pay my loss of earnings?

Yes, if you are unable to work due to the accident, your loss of earnings must be compensated – including household assistance damages. Self-employed persons can claim lost profits.
